These Terms of Use ("Terms") govern your use of the Circles & Squares mobile application (the "App"), provided by Heeler Digital ("we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 17 years old to use the App. By using it, you represent that you meet this requirement and that the information you provide is accurate.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, or resell any part of the App.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
The App lets you create and share content — scores, messages, photos, polls, trip plans, and similar ("User Content"). You retain ownership of your User Content and grant us a license to host, display, and distribute it as needed to operate the App.
You are solely responsible for your User Content, and you agree not to post content that is objectionable, unlawful, harassing, hateful, defamatory, infringing, or otherwise inappropriate. We have zero tolerance for objectionable content or abusive behavior. You can report objectionable content and block abusive users from within the App. We may review reported content and remove content or terminate accounts that violate these Terms, typically within 24 hours of a report.
Circles & Squares is a scorekeeping and organizing tool. Any dollar amounts, side bets, wagers, "who owes who" balances, pots, or ledgers displayed in the App are simply records of arrangements you and your playing partners make among yourselves.
The App does not process, hold, collect, transfer, or facilitate the payment of real money, and does not accept or place wagers. We are not a party to any bet or settlement between users. You are solely responsible for any money that changes hands outside the App and for complying with all laws that apply to you. Nothing in the App constitutes gambling or betting services provided by Heeler Digital.
You agree not to misuse the App, including by attempting to disrupt it, access it without authorization, scrape it, or use it for any unlawful purpose or in violation of others' rights.
The App, including its design, software, and branding, is owned by Heeler Digital and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or content except the limited license above.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or that scores, handicaps, or calculations will be free of inaccuracies.
To the maximum extent permitted by law, Heeler Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any money lost, disputed, or owed between users, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold harmless Heeler Digital from any claims, damages, or expenses arising from your User Content, your use of the App, or your violation of these Terms.
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time and permanently delete your account from Profile → Account → Delete Account. Account deletion does not cancel Apple billing; subscriptions must be managed separately in your Apple ID subscription settings.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date and, where appropriate, providing notice in the App. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules.
